By using Live Media Marketing’s services, you are agreeing to comply with and be bound by the following usage rules.

Please review the following usage rules carefully, and check them periodically for changes. If you do not agree to the usage rules, you should not review information or obtain goods, services or products from our services. You will be emailed when these usage rules changed. If you do not agree to our modified terms, you have 30 days from the time of notification to terminate your service with us. After that time, you are automatically bound by the new terms. We are not responsible for emails not received, ie: spam filters, changed addresses,etc.

PLEASE NOTE: YOU MUST BE 13 YEARS OLD OR OLDER AND A U.S. RESIDENT IN ORDER TO USE OUR SERVICES. IF YOU ARE UNDER 13, YOU MUST FIRST OBTAIN PERMISSION FROM A PARENT/LEGAL GUARDIAN.

1. Acceptance of Agreement. You agree to the terms and conditions outlined in this Terms and Conditions of use Agreement ("Agreement") with respect to our services (the "Services") and our site (the “Site”). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended by us at any time and from time to time without specific notice to you. The latest Agreement will be posted at www.bandtxtalerts.com/usage-rules, and you should review this Agreement prior to using the Services.
2. Verify Members' Address: Live Media Marketing reserves the right to contact a Member via email to verify the accuracy of account information (including the Member's correct name and address) that is needed to provide the Member with the information he or she requested from Live Media Marketing. You also agree to keep us updated with your personal contact information.
3. Monthly plans, message pricing, and other plan details are subject to change at any time. You will be notified in advance in this case.
4. Lists of phone numbers and other subscriber info may not be accessible in user accounts. This is to prevent the privacy of subscribers.
5. You authorize us to use your and/or your band's/client's likeness for promotional purposes and grant us a license to use promotional materials.
6. You agree to pay $0.10 per message per subscriber when they sign up for message subscriptions or send message replies. This applies to subscription confirmation messages sent to the subscriber, messages received from subscribers in the subscription process, and confirmation messages sent back to the subscriber to confirm their subscription. This fee is subject to change. You will be notified in this case.
7. In the event that you violate our terms of service, you agree to pay a penalty of $10 per message per device. This fee offsets penalties by wireless carriers and our time involved in litigation. In the event that our cost is greater than this amount or if damage caused by your violation causes wider-scale damage than this fee, you will be billed for the amount of our damages. If you have any questions in regards to our terms of service, please contact us before taking any action. This will ensure that everyone will be able to continue to use this service without any legal issues.
